Judge Harold Erwin today ruled that Jason Green will be allowed to testify against his brother despite claims by the defense that he must cut a deal to get out of jail on unrelated drug charges.
 
Chad Green is on trial for the murders of a Dalton Couple and their two children. Jason Green, the brother of Chad Green has told prosecutors that his brother admitted to him that he killed the family.
 
Green’s attorney asked the court that Jason Green not be allowed to testify on the grounds that he must have a deal with prosecutors, saying that he was released from jail on unrelated drug charges the same day in 2010 that he implicated his brother Chad Green in the crime.
 
In 1998 Alan Elliott, his wife Lisa Elliot, daughter Felicia and son Gregory were murdered in Dalton. Billy Dale Green, Chad Green’s father was charged on August 1st 2003 for his part in the crime with murder and kidnapping. The crime was labeled as a drug deal that went bad. Billy Green was convicted in 2004 and sentenced to death, only to be overturned by the Arkansas Supreme Court in March 2006. Billy Green is slated to be retried in September, he is serving life for unrelated drug charges.
