So far charges have not been filed concerning a Smithville youth in the death of his brother last year.

Sources claim the state laws will not allow prosecutors to release any details on the case. This also includes whether the youth has or has not been charged but the suspect remains in custody.

The youth admitted to shooting his brother near the grandmother’s home on July 18th 2009 near Smithville according to Lawrence County Sheriff Dan Ellison.

The youth who is now 14 years of age is being held at the White River Detention Center.

The suspect admitted to another relative that the shooting of his brother was intentional. Lawrence County Deputies know the brothers stole the gun from a relative and also knew it was real.

If charged the youth could remain in custody until the age of 21 under special circumstances.
