On February 11, 2012 a Lawrence County Deputy was on patrol on County Rd 556 near Alicia when he got behind a green Chevy pickup. The passenger was throwing beer cans out the window of the vehicle. The deputy stopped the vehicle to speak with the occupants. The deputy immediately noticed a strong odor of beer coming from the driver and passenger. The driver was Derrick Arnold (10/15/86) of Newport and the passenger was Floyd Smith (08/10/88) of Jacksonport. The driver of the vehicle was given field sobriety tests by the deputy and failed the tests. The passenger was also intoxicated. Both subjects were placed under arrest and transported to the Lawrence County Jail. The deputy asked both subjects if they had any illegal substances on them and they replied that they did not. At the jail, Arnold refused to take a BAC test. Arnold was charged with driving on a suspended driver’s license, refusal to take a BAC and it was his third DWI. While at the jail it was discovered that Smith had a bag of marijuana and rolling papers hid in his sock and was trying to sneak them into the jail. Smith was charged with possession of a controlled substance (marijuana), possession of drug paraphernalia, public intoxication, littering and prohibited articles in a jail.
